Terms of service

Version v2026-09-08. Effective 8 September 2026.

These terms are the contract between your organization and nyra health GmbH (nyra labs) for the Nyra Labs API and its dashboard at platform.nyra-labs.com. Read them before you use the API. When your organization accepts them in the dashboard, they bind your organization.

Who we are

We are nyra health GmbH, Salzgries 19/3–4, 1010 Vienna, Austria, commercial register number FN 534581 z. We run the Nyra Labs API under the name nyra labs. Full details are in the imprint. You can reach us at info@nyra.health.

Who may use the API

The API is for businesses and other organizations. It is not for consumers. If you accept these terms for an organization, you confirm that you have the power to bind that organization. You must be at least 18 years old.

In these terms, "you" means the organization. "We" means nyra health GmbH.

The service

The API turns audio into text with our CrisperWhisper speech models. You send one audio file and get back one response. The response holds the verbatim transcript, the intended transcript, word timestamps and the alignment between them. The dashboard lets you manage API keys, your wallet, your team, your usage and your data settings.

The API has limits. These limits apply today and we may change them:

  • 25 MB for each uploaded file
  • 1 hour of audio for each request
  • 600 requests per minute for each API key, unless you set another value in the dashboard

The API documentation describes the API. We may improve, change or remove features. For a breaking change to the public API, we will give you notice in the documentation or by email.

Your account and API keys

You sign in with GitHub, Google or an email address and password. You create an organization and invite your team. Your organization owners decide who has which role.

You are responsible for everything done with your accounts and API keys. Keep your keys secret. Do not put them in public code or in an app that users can inspect. If a key leaks, delete it in the dashboard at once and tell us if you see misuse. We store only a hash of each key. We cannot show you a key again after you create it.

Prices and payment

Billing is prepaid. You add money to a wallet. Each request draws money from the wallet. There is no subscription and no minimum spend.

  • Today the price for CrisperWhisper 2 is 0.90 US dollars for each hour of audio.
  • We count whole seconds of audio. We round up to the next second.
  • A request that fails is not charged.
  • The API lists the current price of each model at GET /v1/models.
  • A top-up costs at least 5 US dollars and at most 10,000 US dollars each time.
  • All prices are in US dollars.

Stripe handles payments. Sales tax or VAT is added at checkout on top of the top-up amount, as the law requires. A top-up of 25 US dollars adds exactly 25 US dollars of credit. We may change prices. We will give you at least 30 days' notice before a price rise applies to you. The new price does not apply to requests made before the change.

If you turn on auto-recharge, you allow us to charge your saved payment method when your balance falls below the trigger amount you set. You can turn it off at any time. If a charge fails, we turn auto-recharge off and send you an email.

Before a request runs, we put a hold on your wallet for the length of the audio plus one second. We release the hold when the request ends and charge only the real cost. If your available balance is too low, the API answers with HTTP status 429 and the error code insufficient_quota.

Refunds and unused balance

Money in your wallet is a prepayment for the API. It does not expire while your account is open. We do not refund a top-up that you have already used. We refund unused balance if you ask us, unless we ended the contract because you broke these terms. If we refund a payment through Stripe, we remove the same amount from your wallet.

If we charge you by mistake, we correct it. Tell us within 90 days of the charge.

Your content and results

Your content is the audio you send and the data you add to your account. The results are the transcripts and other responses we return. You keep all rights you have in your content and in the results. We do not claim ownership of them.

You give us the right to process your content and to create the results only to run the service for you. This includes storing them for the time you choose in your data settings. We do not use your content or results to train or improve our models. We do not sell them or share them with other customers.

You promise that you have the right to send your content to us, and that your use follows the law. If your content has personal data, the data processing agreement applies. You are responsible for any consent or notice that the law requires for the people in your audio.

Data storage and retention

Each organization sets how long we keep the audio, the response body and the response headers of each request. The choices are off, 1 day, 7 days, 30 days and 90 days. If you choose off, we store none of these. We never store API keys or authorization headers. Idempotency replays work only while a response is stored. The privacy policy gives more detail.

Intellectual property

We own the API, the dashboard, the documentation, the models and all related rights. These terms give you a limited right to use the API for your own business. The right is not exclusive, not transferable and can be revoked as these terms say.

These terms do not give you the model weights or a license to run the models yourself. For that, see commercial licensing. You may not copy, resell or reverse engineer the service, or use it to build a competing speech service. The acceptable use policy is part of these terms.

If you send us feedback, we may use it without limit and without payment.

Accuracy of results

Speech recognition makes mistakes. Results can be wrong or incomplete, and they can differ from run to run. Check results before you rely on them. Do not use the API as the only basis for medical, legal or safety decisions about a person. The API is not a medical device.

Availability and support

We work to keep the API running, but we do not promise it is always available or free of errors. We may suspend the service for maintenance or security work. We try to announce planned downtime in advance. If a model backend is full, the API answers with HTTP status 503, and we do not charge the request. We have no service level agreement unless we agree on one with you in writing. For help, write to info@nyra.health.

Suspension and end of the contract

You can stop at any time. Stop using the API, delete your keys and ask us to close your organization.

We may suspend or limit your access at once if you break these terms or the acceptable use policy, if you do not pay, if your use puts the service or other customers at risk, or if the law requires it. If we can, we tell you why and give you a chance to fix the problem. We may end the contract for any other reason with 30 days' notice.

When the contract ends, we delete your stored content as the data processing agreement describes. We pay out your unused balance, unless we ended the contract because you broke these terms. Terms that by their nature continue (for example liability, intellectual property and governing law) continue after the end.

Warranty

We provide the service "as is" and "as available". As far as the law allows, we give no promise that the service fits a special purpose or that results are correct. Rights that you have by law and cannot waive stay in place.

Liability

We are liable without limit for intent, for gross negligence, for injury to life, body or health, and for anything else the law does not allow us to limit.

For slight negligence, we are liable only if we break an obligation that is essential to the contract. In that case, our liability is limited to the typical damage that we could foresee. Our total liability for all claims in a period of 12 months is limited to the amount that you paid us in the 12 months before the first event that caused the damage.

We are not liable for lost profit, lost savings, loss of data that you did not back up, or indirect damage, as far as the law allows. You are liable to us for damage from your breach of the acceptable use policy, within the limits of the law.

Changes to these terms

We may change these terms. Each version has a version number and an effective date. For a material change, we give you at least 30 days' notice by email or in the dashboard. The dashboard asks your organization to accept the new version. If you do not agree, you can stop using the API before the change applies. If you keep using the API after the effective date, the new version applies to you.

General

  • These terms, the acceptable use policy, the data processing agreement and the privacy policy are the full agreement between us on the API.
  • If a part is invalid, the rest stays valid. We replace the invalid part with a valid part that comes closest to its purpose.
  • You may not transfer the contract without our written consent. We may transfer it to a company in our group or to a buyer of our business, and we will tell you.
  • We may use subcontractors. We stay responsible for them.
  • A delay in enforcing a right does not waive the right.
  • Neither of us is liable for a delay caused by events beyond our control.
  • We may send notices to the email addresses of your organization owners and show them in the dashboard.

Governing law and courts

Austrian law governs these terms. The UN Convention on Contracts for the International Sale of Goods and the Austrian conflict-of-law rules do not apply. The courts of Vienna, Austria have exclusive jurisdiction, as far as the law allows.
